Print Story Copyright Counternotification & Stopping It (Nov. 2009)
Law

Another slice of history regarding my video and the man & company that copied it.  Aabbc sent YouTube a letter saying "I have a good faith belief that this material was removed or disabled in error as a result of mistake or misidentification of the material." etc.

I went ballistic at this, as my letter below attests.  Another string....  God almighty - this has been going on for nearly a year now.  I guess I was doing the Japanese thing - trying not to have bad relations and so - reluctantly - responding to the never-ending e-mails that kept landing in my In Box from Aabbc.  I should have ignored them after reading the "Copyright Counternotification" letter he wrote.

Print Story 1st Rejected Contract

This is the first contract the company who was illegally using my video sent me.  I flatly rejected this - saying I needed something in English.  (I can understand it, but it is way too convoluted to clean up, so I didn't/don't want anything to do with it.)  Is this a standard contract?  It seems very... dangerous and unfriendly to me.

Getting close to the wording at issue.  This is all of another string I found.  The continuation is somewhere else.  I'll dig some more....

Note the date of the proposed licensing - it goes way past the take-down request, which I didn't notice at first, but before committing to his suggested contract, which I considered, I realized that date was wrong and suggested a date prior to the take-down request, and then things stalled there.  They suggested another date, but at this point, I realized they were trying to lure me into a trap and were not discussing this in good faith - and then enter [stage left] the lawyer, who was probably in the background all along.

Print Story February & March 2010 VTR (Video Theft Related) E-mails
Law

I'm trying to piece this thing together.  Here's one e-mail string I've found (with names changed to protect the guilty).  Aabbc Bbdde had sent a convoluted contract that I refused outright on the grounds that it wasn't written in English.  I proposed to write out something after looking into things - hoping to get some information from YouTube about what was going on.  I was tricked into thinking that they have a "strike" system "Yup, three strikes and you're out" I think was the wording Aabbc Bbdde used, and as I wasn't out for vengeance, I was trying to be friendly about things.

Incidentally, Aabbc Bbdde not only claims that he didn't personally steal the video, but that he doesn't know who did!  I find this incredible!  How can you post a video that generates three and a half million hits and have no idea where it came from?

In any case, here are some more pieces to the jigsaw puzzle.

Print Story Threatened for not Giving Away My Train Video?

Sigh... That train video again.  I asked one of the copiers to stop illegally using my video.  He/They ignored me.  So I asked Google to help.  They took the illegally posted video down.  Since then, the guy and his company have been harassing me trying to get me to give them permission to use it - which they promise not to do.  Now they are threatening to sue me!  Does this make any sense?

First and foremost - don't click on the link in the text below - I have no idea what it is....  Wait - I'll mutate the sucker with "X"s inserted here and there, which should prevent anyone from accidentally clicking on it.
